These Terms and Conditions (“Terms”) apply to your use of the Badlands Tour Company website and to tours, experiences and related services booked with Badlands Tour Company, a DBA of My XO Adventures LLC (“Badlands Tour Company,” “we,” “us,” or “our”). By booking a tour, using our website, or giving us your information, you agree to these Terms. Please read them together with our Privacy Policy.

1. Introduction

Badlands Tour Company provides private, guided tours of Badlands National Park and the surrounding prairie from Rapid City, South Dakota, including sunset, stargazing and wildlife tours. Every tour is a privately guided experience arranged for you and your group.

We may update these Terms from time to time. The version posted on this page with the “Last updated” date above is the version that applies, and continued use of our website or services after an update means you accept the updated Terms.

2. Tour Bookings and Confirmations

A booking is a request for a specific tour, date and time. Your booking is confirmed once you receive a confirmation from Badlands Tour Company or our booking system.

Tour availability, pricing, group size limits and inclusions are described at the time of booking and may vary by tour and season. Please review your confirmation carefully and tell us right away if any detail (date, time, group size, pickup location or contact information) is wrong. You must give us accurate contact information, including a phone number and email, so we can coordinate your tour.

When you confirm a private tour with us, we no longer accept other reservations for that date and time, because our private tours reserve that time for your group alone.

3. Payments

Full payment is required at the time of booking unless we provide a different written payment arrangement for a specific booking. Custom tours and bookings arranged by phone or email also require full payment unless we agree otherwise in writing. Your tour is not confirmed until payment is completed and a confirmation is issued.

4. Cancellations, Refunds and Rescheduling

Because our tours are privately guided and reserved for your group, and unless a different written policy is provided for a specific booking, the following cancellation and refund schedule applies, measured from the tour start date:

  • 60 days or more before your tour: 75% of what you paid is refunded.
  • 30 to 59 days before your tour: 50% is refunded.
  • 15 to 29 days before your tour: 25% is refunded.
  • 14 days or fewer before your tour, or once it has begun: no refund.

If we cancel a tour for any reason, you get a full refund for that tour.

Rescheduling is subject to availability and may not always be possible. Approved rescheduling requests carry a $174.99 rescheduling fee per tour, per reschedule. Requests made close to the tour date may be treated as a cancellation if we cannot reschedule the tour. We may make exceptions case by case, but exceptions are not guaranteed and do not change the policy for future bookings.

We assign guides on a 60-day schedule, so a late cancellation affects our company, our guides and their families. If you would like protection against unexpected changes, see Travel Protection (Section 11).

To cancel or request changes, contact us as early as possible at 605-252-9100 or daniel@badlandstourcompany.com. Refunds are issued to the original payment method and may take several business days to appear.

5. Weather, Safety and Itinerary Changes

Tours operate outdoors, and weather, road conditions, wildlife activity, park access and other conditions can change quickly. For your safety and the quality of the tour, we may adjust the route, timing, stops or itinerary when conditions require it.

The Badlands can bring rain, snow, wind, heat and periods of smoke from distant wildfires. We do not cancel outings for rain, snow, smoke or wind before or during a tour unless we believe the roads are unsafe. If we decide that a tour cannot operate safely or reasonably and we cancel it, you receive a full refund for that tour. Decisions about safety, including whether to begin, pause, shorten or end a tour, rest with your guide.

Stargazing weather practice

For the Badlands Stargazing Tour, star viewing depends on weather and sky conditions in and around Badlands National Park. The night before the tour and again on the morning of the tour, Badlands Tour Company reviews the forecast. If cloud cover over 60% is forecast, we contact you by text, phone, or both, and the tour is converted to an earlier Badlands Sunset and Golden Hour Tour, focused on wildlife, scenery, and the Badlands sunset, with an earlier pickup and earlier return. If you would rather keep the Badlands Stargazing Tour as originally scheduled and give it a shot, you may tell us so, and the tour operates with the original pickup time.

When Badlands Tour Company converts the tour for weather, it is not treated as a guest rescheduling request and the $174.99 rescheduling fee does not apply.

If the tour operates either way, refunds are not provided solely because stars, clear skies, wildlife, sunset colour, or other natural conditions do not meet expectations.

6. Guest Responsibilities

By booking a tour, you agree that you and your group will:

We may decline service to, or end a tour for, any guest whose conduct is unsafe, unlawful or disruptive, or who is impaired in a way that affects safety.

7. Pickup and Timing

Pickup from lodging in the Rapid City area, including Keystone, carries no additional charge. Pickups farther away may carry an additional charge, shown before you complete your booking, and may include $99 per additional hour of guide driving time. If your preferred pickup point is not listed at booking, contact us and we will do our best to accommodate it.

Please be ready at your pickup location at the scheduled time. Because tours are privately scheduled, a significant delay may shorten your tour or, in some cases, be treated as a no-show. If you cannot find your guide or need to reach us on the day of your tour, call 605-252-9100.

8. Photos and Media

You may be asked to complete a waiver before the tour. The standard waiver may include permission for Badlands Tour Company and its guides to take photos or video during the tour, share them with you, and use them for our marketing, website, social media or related business purposes. If you sign the standard waiver granting photo permission, we may use those photos or video without further notice or separate approval.

If you do not want photos or video taken or used, ask for the no-photo waiver option before the tour. When a no-photo waiver is completed, we note that preference for the guide, who may avoid taking photos entirely or avoid taking photos of you with a company or guide camera.

9. Third-Party Booking and Service Providers

We use trusted third-party providers to help deliver our services, including an online booking and checkout provider and an electronic waiver provider. When you book or sign a waiver, you may interact with their systems, and they process your information under their own terms and privacy policies, which we encourage you to review. We are not responsible for the independent acts or omissions of third-party providers, but we will work with you in good faith to resolve any issue related to your tour.

10. Gift Certificates

Gift certificates are transferable between guests and do not expire. They may be used toward tour payments and guide tips, and they cannot be redeemed for cash.

11. Travel Protection

We recommend that guests buy travel protection before their trip. It can help cover trip cancellations and interruptions, travel delays, medical expenses, emergency assistance, cancelled flights, and lost or delayed baggage. Accidents, injuries, illness, flight delays, weather, natural events and other unexpected circumstances can lead to cancellations inside our cancellation periods, and without travel protection those events can mean the loss of the amount paid under the schedule in Section 4.

12. Text Messaging Terms

By giving us your phone number and choosing to receive text messages, you agree to receive SMS messages about your inquiry, booking, tour logistics, pickup details, schedule changes, weather updates, waiver reminders and guest support. Message frequency varies with your inquiry, booking and tour activity, and message and data rates may apply. You may opt out at any time by replying STOP, after which you may receive one final confirmation message. For help, reply HELP or call 605-252-9100. Consent to receive text messages is not a condition of buying a tour.

13. Assumption of Risk and Limitation of Liability

Outdoor tours involve inherent risks, including uneven terrain, weather, wildlife, travel and other conditions that are part of the natural environment. By taking part, you accept these inherent risks for yourself and your group. You may be required to sign a separate waiver and assumption-of-risk agreement before your tour, and that waiver applies in addition to these Terms.

To the fullest extent permitted by law, Badlands Tour Company and My XO Adventures LLC are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of our website or participation in a tour. Nothing in these Terms limits any liability that cannot be limited under applicable law.

14. Website Use

The content on our website is provided for general information and may change without notice. We aim for accuracy but do not guarantee that all content is complete or current. Website content, including text, images and logos, belongs to My XO Adventures LLC or its licensors and may not be copied or used without permission, except as allowed by law. Our website may link to third-party sites we do not control, and we are not responsible for their content or practices.

15. Governing Law

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or your tour will be brought only in the state or federal courts located in Pennington County, South Dakota, and you consent to the jurisdiction of those courts.
